General Terms and Conditions of Sale

These General Terms and Conditions of Sale ("Terms") govern the sale of products offered through the website dcarnivores.it, owned by:

2. Ordering procedure
The website displays the products (for example carnivorous plants, substrates, accessories) for informational purposes.
To purchase, the customer must submit a request through the website and follow the instructions.
The Seller will reply confirming availability, total price, shipping costs, and payment methods.
The order is deemed accepted only after the Seller's written confirmation, with the related invoice/receipt sent via email.
3. Prices
All prices shown on the website are expressed in euro (EUR) and include VAT, unless otherwise indicated.
Any shipping costs will be communicated to the customer before the order is confirmed.
4. Payments
Payments are made only after the order has been confirmed, using the methods agreed from time to time, for example:
- Bank transfer
- PayPal (manual link sent)
- Other methods possibly available upon request
At present, no automatic payment system is active on the website.
5. Shipping and delivery
- Shipments are generally made via UPS, unless otherwise agreed with the customer.
- Orders over 100 EUR qualify for free shipping when available for the selected shipping zone.
- Delivery times are communicated at the time of order confirmation (usually 2-5 working days).
- The Seller is not responsible for any delays due to the courier or to force majeure.
- Upon delivery, the customer must check that the parcel is intact and report any damage within 48 hours.
Plant shipping conditions
All plants are shipped via UPS unless the customer requests a different courier service. If the customer chooses a different courier, D.Carnivores cannot be held responsible for delays, damage, loss, or other shipping-related issues caused by the selected carrier.
Plants are shipped bare-root, and pitchers or traps are cut before shipment, unless the customer makes a specific request. Bare-root shipping generally helps plants preserve better during transit compared with potted shipments, especially for long-distance deliveries, as the growing medium inside pots may dry out during transport.
Shipping plants potted and/or with pitchers or traps attached may increase the risk of mold developing inside the package and may negatively affect the plant's preservation during transit, especially in case of delivery delays or customs inspections.
If an order includes both plants and seeds, the items may be shipped in two separate parcels for better preservation and handling. No additional shipping costs will be charged for the seeds parcel, which is offered free of charge.
6. Right of withdrawal
The customer has the right to withdraw from the purchase within 14 days from receipt of the goods, pursuant to Art. 52 of Italian Legislative Decree 206/2005, by notifying their intention via email or WhatsApp.
The refund will be made within 14 days from receipt of the returned products in perfect condition.
Live plants, perishable goods, or products that are likely to deteriorate or expire rapidly cannot be returned (Italian Consumer Code, Art. 59, paragraph 1, letter d).
7. Warranty
The provisions on statutory liability for defects apply.
Any issues or non-conformities must be reported within 1 month from discovery.
8. Limitation of liability
The Seller shall not be liable for any indirect damages resulting from improper use of the products or from force majeure.
In any case, the total liability shall not exceed the total amount of the order.
9. Governing law and jurisdiction
These Terms are governed by Italian law.
For any dispute, the competent court shall be that of the consumer, unless otherwise agreed between the parties.
